Death & Survivor Benefits

As a VCERA member, death and survivor benefits may be payable to your eligible surviving spouse, minor children, beneficiaries or estate. Death and survivor benefits depend on many different factors and can only be determined after a full review of each member’s individual circumstances. The following is a general description of benefits that may be paid upon the death of a member.

Divorce & Community Property

Your VCERA pension is considered a community property asset. Determination of  division of this asset during divorce, legal separation or dissolution of domestic partnership is required prior to retirement or withdrawal of contributions.

VCERA can assist members by providing a pre-judgment summary which isolates the service, contributions, and interest earned during the community property period. This can be particularly helpful during the initial part of the dissolution process. VCERA can also provide Domestic Relations Order (DRO) templates to file with the court.
